Conditions of sale
These conditions are agreed to between, on the one hand company Anne Maisonneuve, SARL with a capital of 7623 euros, and domiciled at 112 Boulevard Raspail 75006 Paris, registered at the Paris trade registry under number 424 208 296, hereinafter “AM”, and on the other hand, any individual or legal entity wishing to proceed with a purchase through AM website, hereinafter the “Buyer”.
These conditions aim at defining the contractual relationship between AM and the Buyer, and the conditions which will apply to any purchase through the AM business website: “annemaisonneuve.com”, whether the Buyer is a professional or the consumer.
Purchasing a product through this website constitutes full acceptance by the Buyer of these sales conditions.
These sales conditions shall prevail upon any other general or specific conditions, unless any exception is expressly agreed to by AM.
AM reserves the right to amend its sales conditions, at any time. In case of amendment, the conditions applicable shall be those in force on order date by the Buyer.
The products offered are those listed in the catalogue published on the AM website.
All products are offered subject to stock availability.
Each product comes with a description provided by the supplier.
Photographs and images appearing in the catalogue are as accurate as possible to the offered product, but do not warrant perfect similarity with the offered product, especially as far as colours and position of customized prints are concerned.
Prices listed in the catalogue include VAT, and are in euros, taking into account applicable VAT in France on the day of the order; any change in VAT rate may be reflected in product price.
AM reserves the right to amend its prices any time; nonetheless it is clearly understood that the price charged to the Buyer will be the one showing on the catalogue on the day of the order.
Prices do not include order handling expenses, nor transportation and delivery costs. The Buyer is informed of these costs, before payment, on the order summary page.
Products shipped outsize the European Union and to Overseas provinces and territories, may be subject to customs duties, local duties, import taxes or any other state taxes. They are for Buyer’s account and are his entire liability, as far as declaration and payment to the relevant authorities and organizations are concerned.
Online sale of the products listed on the site are reserved to Buyers residing in the geographic areas mentioned in the identification form and for delivery requested to these areas.
Any Buyer wishing to purchase a product must:
Complete the online purchase basket;
Provide all information requested in the identification form;
Complete the payment form under the conditions provided;
Accept these sales conditions;
Validate his order after having checked it;
Confirm his order and his payment.
Order confirmation entails the acceptance of these sales conditions, acknowledgement of its contents and waiver of any personal purchase conditions or any other conditions.
The data provided and the recorded confirmation will serve as proof of the transaction. Confirmation will serve as signature and acceptance of the operations carried out.
AM will confirm by e-mail the recorded order.
Withdrawing right applies to products in their original condition.
The Buyers, non-professional individuals, benefit of a withdrawing period of seven days from delivery date of the order, to return the product to AM and obtain replacement or reimbursement, without any penalty, except for return expenses.
Payment is due upon ordering.
Payments are made by bank card, Visa, MasterCard or Carte Bleue; they are secured by the SSL protocol (Secure Socket Layer) which ciphers data transmitted on internet.
Buyer’s account will be debited upon dispatching the available products and only for the amount of shipped products.
Buyer will receive by e-mail the instructions to download the invoice showing VAT. A paper invoice will be sent upon request.
Deliveries are made to the address showing on the order form, which can only be located within the geographic areas listed on the identification form.
Risks are for Buyer’s account starting from the time the products leave AM premises. In case of damage during transportation or missing product, a claim must be directed to the carrier within a three day period starting from delivery date.
In case of delivery of wrong product, a claim must be placed with AM within a three day period starting from delivery date. In this case, Buyer may request replacement or reimbursement of the product. Return expenses are for AM´s account.
Delivery times are given as a guidance; if they exceed 30 days from order date, the contract may be cancelled and Buyer will be reimbursed.
Buyer may pick up his order himself at the AM shop: Anne Maisonneuve, 112 boulevard Raspail 75006 Paris, France.
All products supplied by AM come under the legal warranty provided for in articles 1641 and following of the Civil Code.
In case of having sold a product not complying with French law in force, the product may be returned to AM, which will take it back, to replace or reimburse it.
Any claim, request for replacement or reimbursement must be notified by mail to the following address: Anne Maisonneuve, 112 boulevard Raspail 75006 Paris, France, within a 30 day period starting from delivery date.
Within the online sale process, AM´s liability is limited to means; its liability may not be engaged for damage resulting from the use of the web, such as loss of data, intrusion, virus, service failure, or any other unintentional problem.
Regarding shipping outside France, it is Buyer’s duty to check with local authorities, on import requirements of said product. AM’s liability will not be engaged in case of non compliance with the law of the country the product is shipped to.
All parts of the AM website are and remain the exclusive intellectual property of AM.
Nobody is authorized to reproduce, operate, distribute, or use for any purpose it may be, even partially, parts from the website, whether they are programmed, visual or acoustic.
According to the January 6, 1978 law on computer systems, files, and liberties, any personal data on Buyers may be handled with an automated process.
Data on Buyers is collected using the forms and may be forwarded to business partners for handling of the order, transportation and delivery purpose.
Buyers may oppose the release of their personal data by advising AM. Furthermore, users have an access and amending right concerning their personal data, as per January 6, 1978 law.
The automated data processing, including the management of the e-mail addresses of website users, was filed with the CNIL on February 25, 2008, under number 1279382.
Filing & Proof
AM will file the order forms and invoices on a reliable and lasting support, to obtain a faithful copy according to the dispositions of article 1348 of the Civil Code.
AM computer files will be considered by the parties as proof of notices, orders, payments and transactions between the parties.
These sales conditions come under French law.
In case of dispute, relevant courts will be the Paris court, notwithstanding several defenders or warranty claim.
